Tie-Breaking Rule for Express Entry – What Is It?

Immigration, Refugees and Citizenship Canada has started to use a tie-breaking rule in the Express Entry Draws. This rule only applies to those candidates in the Express Entry Pool with the same score as the lowest score selected in any draw. It does not effect those with a score higher than the lowest score selected.

For example, if you are in the Express Entry System and your Comprehensive Ranking System Score is 448, and they select anyone with a score of 444 or above, you would not be effected by the tie-breaking rule. If you had a score of 444 however, then the tie-breaking rule would apply to you. Each time a draw now occurs, Immigration, Refugees and Citizenship Canada now posts a tie-breaking rule date. If your application was in the Express Entry Pool before, or on this tie-breaking rule date, then you would also receive an Invitation to Apply. If your application was not in the Express Entry Pool before the tie-breaking rule date, then you would not receive an Invitation to Apply.

Another example is as follows:

• Joe entered his profile into the Express Entry System on January 1st, 2018 and received confirmation that he was entered into the Express Entry Pool on January 1st, 2018 with a score of 444.
• Amy entered her profile into the Express Entry System on January 21st, 2018 and received confirmation that she was entered into the Express Entry Pool on January 21st, 2018 with a score of 444.
• Paul entered his profile into the Express Entry System on January 23rd, 2018 and received confirmation that he was entered into the Express Entry Pool on January 23rd, 2018 with a score of 445.
• On January 24th, 2018, Immigration, Refugees and Citizenship Canada handed out 2,750 Invitation to Apply to anyone who had a score of 444 or above, with a tie-breaking rule of January 17th, 2018.
• Joe and Paul would both receive an Invitation to Apply
• Amy would not receive an Invitation to Apply
