OINP Employer Job Offer: International Student stream

The Ontario Immigrant Nominee Program (OINP) Employer Job Offer: International Student stream requires applicants to submit an Expression of Interest (EOI) through the OINP website. This EOI will be used to assign applicants a score, which the Ontario Immigrant Nominee Program (OINP) uses to select applicants. Try our free OINP Points Calculator to see what you would score!

If an applicant is selected by the OINP based on their EOI, they will be given 14 calendar days to submit their full application to the OINP. If that application is then approved, they will receive a provincial nomination. After receiving a provincial nomination, applicants can then apply to Immigration Refugees and Citizenship Canada (IRCC) for permanent residence. The Employer Job Offer: International Student stream does not require an Express Entry profile. This means that applicants who receive a provincial nomination under this stream will not submit their application for permanent residence through the Express Entry system.

Job Offer Requirements

For the Ontario Immigrant Nominee Program (OINP) Employer Job Offer: International Student stream, the applicant needs to have a full-time (minimum of 30 hours per week), paid, permanent position with an indeterminate duration from an employer in Ontario. Self-employed professionals are not eligible.

The job offer needs to meet the following criteria:

NOC CategoryThe job must fall under TEER category 0, 1, 2, or 3 of the National Occupation Classification (NOC).
Wage LevelThe offered wage must meet or be higher than the low wage level for that occupation in the specific region of Ontario where the applicant will be working (excluding bonuses or discretionary benefits).
Business NecessityThe position must be essential to the employer’s business.
Work LocationWork must take place primarily in Ontario.
Equity OwnershipThe applicant or their family members cannot hold or have held more than 10% equity in the employer’s company.

 

Applicant Requirements

For the Ontario Immigrant Nominee Program Employer Job Offer: International Student stream, the main applicant needs to meet all the following criteria:

  • obtained one of the following eligible credentials:
    • an undergraduate degree or diploma that takes at least two years if pursued on a full-time basis from an eligible Canadian institution
    • a graduate degree or diploma that takes at least one year if pursued on a full-time basis from an eligible Canadian institution
    • a college graduate certificate that takes at least one year to complete if pursued on a full-time basis from an eligible Ontario institution
    • a university graduate certificate that takes at least one year to complete if pursued on a full-time basis from an eligible Ontario institution
  • more than half of the requirements necessary to obtain your credential were obtained while living and studying in Canada
  • if your job offer is for an occupation that requires a mandatory licence or other authorization in Ontario, you must hold a valid licence or authorization from the appropriate regulatory body in Ontario when you apply
  • you must submit your application within two years of completing the requirements necessary to obtain your degree, diploma or certificate (also known as your education credential)
  • the date on your educational credential must be within two years of your OINP application submission date, not the date you received the invitation to apply
  • the intention to live in Ontario
  • legal status in Canada, if applying from within Canada

Employer Requirements

For the Employer Job Offer: International Student stream, the applicant needs to ensure that their employer meets all of the following requirements before submitting an Expression of Interest (EOI):

Active BusinessEmployer must have been in active business for at least three years before application submission.
Business LocationEmployer must have business premises in Ontario where the applicant will work or report to work.
Legal ComplianceEmployer must have no outstanding orders under the Ontario Employment Standards Act, 2000 or the Occupational Health and Safety Act.
Recruitment EffortsEmployer must demonstrate that efforts were made to hire a Canadian citizen or permanent resident before offering the position, unless the applicant already has a valid work permit for Ontario, or the employer has a positive Labour Market Impact Assessment (LMIA) for the position.
Minimum Gross Annual RevenueInside GTA: $1,000,000+ if the job is inside the GTA.

Outside GTA: $500,000+ if the job is outside the GTA.

Minimum Number of Full-Time EmployeesInside GTA: Employer must have at least 5 full-time employees who are Canadian citizens or permanent residents at the job location.

Outside GTA: Employer must have at least 3 full-time employees who are Canadian citizens or permanent residents at the job location.

Employer FormEmployer must complete and sign the Application for Approval of an Employment Position (Employer Form).
